Text of the Antarctic Treaty for the Prohibition of the Development, Production, Stockpiling, Transfer, Use or Threat of Use of Bacteriological (Biological) and Toxin, Chemical, and Nuclear Weapons, and the Use or Threat of Use of Orbital Gravity-Accelerated Kinetic Weapons of Mass Destruction
Signed at Bolse Station, Antarctica on 31 January, Universal Century 0079, and concurrently entered into force.
The States Parties to this Treaty,
DETERMINED to act with a view to achieving effective progress towards general and complete disarmament, including the prohibition and elimination of all types of weapons of mass destruction,
DESIRING to contribute to the strengthening of confidence between peoples and the general improvement of the international atmosphere,
CONVINCED of the importance and urgency of eliminating from the arsenals of Nations, through effective measures, such dangerous weapons of mass destruction as those using chemical or bacteriological (biological) agents or nuclear devices,
DETERMINED for the sake of all mankind, to exclude completely the possibility of weapons of mass destruction used against peoples of both Earth and Space,
Have agreed as follows:
Article I
Each State Party to this Treaty undertakes never in any circumstances to develop, produce, stockpile or otherwise acquire or retain:
(1) Microbial or other biological agents, or toxins whatever their origin or method of production, of types and in quantities that have no justification for prophylactic, protective or other peaceful purposes;
(2) Weapons, equipment or means of delivery designed to use such agents or toxins for hostile purposes or in armed conflict.
Each State Party to this Treaty undertakes never under any circumstances:
(1) To develop, produce, otherwise acquire, stockpile or retain chemical weapons, or transfer, directly or indirectly, chemical weapons to anyone;
(2) To use chemical weapons;
(3) To engage in any military preparations to use chemical weapons.
Each State Party to this Treaty undertakes never under any circumstances:
(1) To use or threaten to use nuclear weapons;
(2) To engage in any military or other preparations to use nuclear weapons;
(3) To develop, test, produce, otherwise acquire, deploy, stockpile, or transfer nuclear weapons;
(4) To develop, test, produce, otherwise acquire, stockpile, retain, transfer or use proscribed nuclear material;
(5) To develop, test, produce, otherwise acquire, deploy, stockpile, maintain, or transfer nuclear weapons delivery vehicles;
(6) To develop, test, produce, otherwise acquire, stockpile, maintain, or transfer nuclear weapon components or equipment.
Each State Party to this Treaty undertakes never under any circumstances:
(1) To use or threaten to use any object of dimensions greater than five hundred meters on any plane as a gravity-accelerated weapon;
(2) To engage in any military or other preparation to use such an object as a gravity-accelerated weapon;
(3) To develop, produce, otherwise acquire, deploy, or stockpile impulse articles capable of moving such an object for any purpose prohibited by Article I.
Article II
(1) Both State Parties affirm, by virtue of recognized mutual interest and commitment to the protection of all mankind, that all territorial rights and sovereignties of neutral Governments and related entities shall be respected, pursuant to the terms and limitations of the Hague Convention of AD 1907.
(2) Any Government may, by means of formal and open declaration, accede to the status of Neutral Power, and shall abide by all terms and limitations specified in Article II.
Article III
Each State Party to this Treaty undertakes to destroy, or to divert to peaceful purposes, as soon as possible but not later than eighteen months after entry into force of the Treaty, all agents, toxins, weapons, equipment, means of delivery or other prohibited article specified in article I of the Treaty, which are in its possession or under its jurisdiction or control. In implementing the provisions of this article all necessary safety precautions shall be observed to protect populations and the environment.
Article IV
Each State Party to this Treaty undertakes not to transfer to any recipient whatsoever, directly or indirectly, and not in any way to assist, encourage, or induce any private, State, national, international or interspheral organizations to manufacture or otherwise acquire any of the agents, toxins, weapons, equipment, means of delivery or other prohibited articles specified in article I of this Treaty.
Article V
Each State Party to this Treaty shall, in accordance with its constitutional processes, take any necessary measures to prohibit and prevent the development, production, stockpiling, acquisition, or retention of the agents, toxins, weapons, equipment, means of delivery and other prohibited articles specified in article I of the Treaty, within the territory of such State, under its jurisdiction or under its control anywhere.
Article VI
The States Parties to this Treaty undertake to consult one another and to cooperate in solving any problems which may arise in relation to the objective of, or in the application of the provisions of, the Treaty. Consultation and Cooperation pursuant to this article may also be undertaken through appropriate international procedures at agreed-upon neutral locations.
Article VII
Each State Party to this Treaty affirms the recognized objective of effective prohibition of chemical, nuclear and biological weapons and, to this end,
undertakes to continue negotiations in good faith with a view to reaching early agreement on effective measures for the prohibition of their development, production and stockpiling and for their destruction, and on appropriate measures concerning equipment and means of delivery specifically designed for the production or use of nuclear or chemical or biological agents for weapons purposes.
Article VIII
(1) The States Parties to this Treaty undertake to facilitate, and have the right to participate in, the fullest possible exchange of equipment, materials and scientific and technological information for the use of chemical, bacteriological (biological) agents and toxins, and nuclear technology, inclusive of Minovsky-derived articles, for peaceful purposes.
(2) This Treaty shall be implemented in a manner designed to avoid hampering the economic or technological development of States Parties to the Treaty or international cooperation in the field of peaceful chemical, nuclear and bacteriological (biological) activities, including the international exchange of bacteriological (biological) and toxins and equipment for the processing, use or production of bacteriological (biological) agents and toxins for peaceful purposes, in accordance with the provisions of the Treaty.
Article IX
Pursuant to the Hague and Geneva Conventions of AD 1899, 1925, and 1946, the United Nations Charter of AD 1947, and the Earth Federation Charter of AD 1999, the fundamental human rights of civilians, prisoners of war and other persons shall be respected in according fashion.
Article X
Any State Party may propose amendments to this Treaty. Amendments shall enter into force for each State Party accepting the amendments upon their acceptance by both States Parties to the Treaty.
Article XI
This Treaty shall be of unlimited duration.
Article XII
(1) This Treaty shall be open to all States for signature. Any State which does not sign the Treaty before its entry into force in accordance with paragraph (3) of this Article may accede to it at any time.
(2) This Treaty shall be subject to ratification by signatory States. Instruments of ratification and instruments of accession shall be deposited with the Governments of the Earth Federation, the Duchy of Zeon, and the Riah Republic, which are hereby designated the Depositary Governments.
(3) This Treaty shall enter into force after the deposit of instruments of ratification by the Governments designated as Depositaries of the Treaty.
(4) For States whose instruments of ratification or accession are deposited subsequent to the entry into force of this Treaty, it shall enter into force on the date of the deposit of their instruments of ratification or accession.
(5) The Depositary Governments shall promptly inform all signatory and acceding States of the date of each signature, the date of deposit or each instrument of ratification or of accession and the date of entry into force of this Treaty, and of the receipt of other notices.
Article XIII
This Treaty, the English, Russian, French, Spanish, Italian, Chinese, and Japanese texts of which are equally authentic, shall be deposited in the archives of the Depositary Governments. Duly certified copies of the Treaty shall be transmitted by the Depositary Governments to the Governments of the signatory and acceding states.
IN WITNESS WHEREOF the undersigned, being duly authorized to that effect, have signed this Treaty.
